dirtlej GmbH, hereafter also referred to as dirtlej

  1. SCOPE OF APPLICATION, TERMS OF REGULATIONS

    1. These terms and conditions apply exclusively to the business relationship between dirtlej GmbH, Im Wörth 5, 79576 Weil am Rhein, Germany ("dirtlej") and the customer, in relation to the dirtlej online store in Germany available at www.dirtlej.com ("Online Store") in the version valid at the time of the order.

    2. Deviating, conflicting, or supplementary terms and conditions—even if known—do not become part of the contract unless their applicability is expressly confirmed in writing.

    3. The Online Store is directed exclusively at customers who reside in Germany or the European Union, have a delivery and billing address within this area, and are consumers under German law (§ 13 BGB), meaning natural persons who conclude a legal transaction for purposes that are not primarily related to their commercial or self-employed professional activities.

    4. INTELLECTUAL PROPERTY
      Our services, including but not limited to all trademarks, trade names, texts, illustrations, images, graphics, product reviews, video and audio files, as well as their design, selection, and arrangement, are the property of dirtlej, its affiliates, or licensors and are protected by U.S. and international patent, copyright, and other intellectual property laws.
      These Terms and Conditions permit you to use the services solely for personal, non-commercial purposes. Without our prior written consent, you may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any material from the services. Except as expressly stated herein, nothing in these Terms and Conditions grants you a license or other rights to any patents, trademarks, copyrights, or other intellectual property of dirtlej, Shopify, or third parties, nor may such rights be implied. Unauthorised use of the services may violate local and international intellectual property laws. All rights not expressly granted herein are reserved by dirtlej.
      The names, logos, product and service names, designs, and slogans of dirtlej are trademarks of dirtlej or its affiliates or licensors. You may not use these marks without the prior written permission of dirtlej. The name, logo, product and service names, designs, and slogans of Shopify are trademarks of Shopify. All other names, logos, product and service names, designs, and slogans on the services are the trademarks of their respective owners.

    5. RELATIONSHIP TO SHOPIFY
      dirtlej is operated by Shopify, which enables us to provide the services to you. However, all sales and purchases you make in our shop are made directly with dirtlej. By using the services, you acknowledge and agree that Shopify is not responsible for any aspects of the business relationship between you and dirtlej, including injuries, damages, or losses caused by purchased products and services. You hereby expressly release Shopify and its affiliates from any and all liability for claims, damages, and obligations arising out of or in connection with your purchases and transactions with dirtlej.

  2. CONCLUSION OF CONTRACT

    1. The presentation of products in the Online Store is not a legally binding offer, but an invitation for the customer to make an offer to enter into a purchase agreement. Product colours may differ slightly from what is displayed in the Online Store due to variations in display devices.

    2. An online order constitutes the customer's offer to enter into a contract with dirtlej GmbH. The order confirmation via email does not represent acceptance of the offer but merely confirms receipt of the order. Orders placed by phone also do not constitute binding acceptance by dirtlej GmbH. Acceptance of the order takes place either when the goods are shipped or, in the case of advance payment, when a payment request is sent via email.

    3. The company dirtlej GmbH reserves the right not to accept online orders. The company may accept the contractual offer within two weeks of receipt.

    4. The company dirtlej GmbH is authorised to limit the order to an amount for a common household.

    5. If a product is not or only partially available, the customer will be immediately informed. The full or partial payment will be immediately refunded.

    6. The language of the contract is German.

    7. Your contractual partner is dirtlej GmbH.

  3. SHIPPING

    1. Unless otherwise agreed, goods will be shipped to the delivery address specified in the order using the chosen shipping method. Partial deliveries are permitted as long as they are reasonable for the customer. We will indicate this in the shipping confirmation.

    2. Shipping is carried out via DHL Standard Shipping or DPD. Unless otherwise stated, items are shipped approximately 5 days after the order is placed.

    3. Delays caused by disruptions beyond dirtlej GmbH’s control (e.g., with logistics partners or due to force majeure) may extend delivery times. In such cases, dirtlej will inform you as soon as possible and provide a revised delivery date which is appropriate given the circumstances. If the item remains unavailable after this period for reasons not attributable to dirtlej, the company may withdraw from the contract. Customers may also withdraw from the contract if the delay makes it unreasonable to accept the goods. The company dirtlej GmbH requests that you inform us at least via E-mail. Any payment already made will be refunded promptly. Your statutory rights remain unaffected.

  4. REWARD AND RESERVATION OF PROPRIETARY RIGHTS

    1. All prices specified in the online-store (dirtlej GmbH) are in Euro and include the applicable statutory VAT. The prices valid at the time of ordering apply.

    2. Shipping costs to be paid by the customer are listed in the shopping cart before checkout.

    3. Payment of orders in the Online Store can be made through PayPal or pre-payment (bank transfer in advance). In case of payment by credit card, we accept Visa, Mastercard and American Express. In addition, ApplePay, GooglePay and ShopPay can be used.

    4. Payment of purchase price is due immediately upon contract conclusion. This includes the product's original packaging. Goods must be returned with the original packaging, which must be undamaged.

    5. By payment via pre-payment (bank transfer in advance), the shipping of the ordered products only occur after the payment of the full amount has been received on our bank account. This payment has to happen within 7 working days after the sending of the purchase confirmation. The confirmation of purchase calls for a timely payment, otherwise the agreement for sale and the obligation for delivery is void.

    6. Ownership of the goods remain with dirtlej GmbH until full payment is received.

  5. SHIPPING COSTS

    1. Shipping in Germany

      For orders under €129.00, a shipping fee of €5.49 applies. For orders above €129.00, shipping remains free. We ensure your items are sent as an insured package, primarily via climate-neutral DPD shipping. All prices are in EUR and include German VAT. Once your order is dispatched, we’ll send you a tracking number by email to monitor your shipment online. We will also provide a pre-paid return label should you need to return any item(s).

      Shipping in Europe

      We ship to Austria, France (mainland only), Belgium, Czech Republic, Denmark (mainland only), Spain (mainland only), Hungary, Italy, Lithuania, Luxembourg, Latvia, Netherlands, Poland, Portugal (mainland only), Slovakia, and Slovenia. For orders below €129.00, a shipping fee of €8.99 (Belgium, Denmark, Luxembourg, Netherlands, Austria, Czech Republic), €12.99 (France, Italy, Poland, Slovakia, Slovenia) or €15.99 (Latvia, Lithuania, Portugal, Spain, Hungary) will be charged. For orders above €129.00, shipping is free. We will also provide a pre-paid return label should you need to return any item(s).

  6. RIGHT OF WITHDRAWAL

    The right of withdrawal applies only to consumers.

    Cancellation before shipping
    As long as individual items in an order have not yet been shipped or fulfilled, these items may be cancelled. Cancellation is only possible until the respective item has been prepared for shipping or fulfilled.

    Once an item has been shipped or fulfilled, cancellation is no longer possible. In this case, the following right of withdrawal applies.

    You have the right to withdraw from this contract within 30 days without giving any reason.

    The withdrawal period is 30 days from the day on which you, or a third party named by you who is not the carrier, have/has taken possession of the last item in the order.

    If the end of the withdrawal period falls on a Saturday, Sunday or public holiday, the period ends on the next working day.

    by means of a clear statement, for example by a letter sent by post or by email, of your decision to withdraw from this contract.

    You may use the model withdrawal form for this purpose, but this is not mandatory. You may also submit any other clear statement.

    To meet the withdrawal deadline, it is sufficient for you to send the notification of exercising your right of withdrawal before the withdrawal period expires, or to use the online withdrawal function before the withdrawal period expires.

    Effects of withdrawal

    If you withdraw from this contract in full, we will refund all payments we have received from you, including the original standard delivery costs.

    Additional costs resulting from your choice of a delivery method other than the cheapest standard delivery offered by us will not be refunded.

    If you withdraw only individual items from an order and the value of the products you keep falls below the free delivery threshold of €129.00, the original standard delivery costs will be deducted from the refund amount.

    In this case, the following original standard delivery costs will be deducted from the refund amount:

    €5.49 for deliveries within Germany
    €8.99 for deliveries to Belgium, mainland Denmark, Luxembourg, the Netherlands, Austria and the Czech Republic
    €12.99 for deliveries to mainland France, Italy, Poland, Slovakia and Slovenia
    €15.99 for deliveries to Latvia, Lithuania, mainland Portugal, mainland Spain and Hungary

    We will issue the refund without undue delay and no later than 14 days from the day on which we receive your notification of withdrawal.

    For this refund, we will use the same payment method that you used for the original transaction, unless expressly agreed otherwise with you. In no case will you be charged any fees for this refund.

    We may refuse the refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.

    You must return or hand over the goods to us without undue delay and in any event no later than 14 days from the day on which you inform us of your withdrawal from this contract:

    The deadline is met if you send the goods before the period of 14 days has expired.

    We bear the cost of returning the goods.

    You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that was not necessary to check their condition, properties and functionality.

    Please return the goods in the original packaging whenever possible. If the original packaging is no longer available, the goods must be returned in suitable packaging that adequately protects them during return transport.

  7. END OF WARRANTY

    1. Consumers can choose between repair or replacement. dirtlej GmbH can refuse the chosen option if it involves disproportionate costs and the alternative poses no significant disadvantage to the consumer. For companies, it is the choice of the company dirtlej GmbH to provide warranty for defect of the articles through rework or replacement.

    2. If the supplementary performance fails, it is up to the customer to basically demand for reduction of the price (decrease) or cancellation of the sale (withdrawal) and claim for compensation. If there are only slight defects, the customer does not have the right to cancellation of the sale. If the customer choses compensation, the liability limitation according to point 8 of the terms and conditions (return of unused articles) apply.

    3. Customers have to show obvious defects of the articles to the company dirtlej GmbH within 2 months after their receipt in a written form; otherwise the enforcement of the claim for warranty is excluded.

    4. Retailers have to immediately check the delivered articles for deviation of quality and quantity and tell the company dirtlej GmbH about visible defects or missing quantities within a week after receiving the articles in a written form; otherwise the enforcement of the claim for warranty is excluded.

    5. Hidden defects have to be told to the company dirtlej GmbH within a week after discovery in a written form. To meet the deadline, it is enough to notify us via email or phone call. The retailer bears the entire burden of proof for all eligibility criteria, in particular for the defect itself, for the moment of the discovery of the defect and the timeliness of the notification of defects.

    6. The period of warranty for customers is two years from the delivery of the products. The period of warranty for retailers is one year from the delivery of the products.

WE DO NOT GUARANTEE OR WARRANT THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF IMPLIED OR OTHER WARRANTIES, SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU.

    8. LIMITATION OF LIABILITY
      TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL DIRTLEJ, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, OR LICENSORS, OR THOSE OF SHOPIFY AND ITS AFFILIATES, BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS, OR ANY SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, ARISING FROM YOUR USE OF ANY OF THE SERVICES OR ANY PRODUCTS PROCURED USING THE SERVICES, OR FOR ANY OTHER CLAIM RELATED IN ANY WAY TO YOUR USE OF THE SERVICES OR ANY PRODUCT, INCLUDING, BUT NOT LIMITED TO, ANY ERRORS OR OMISSIONS IN ANY CONTENT, OR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF THE SERVICES OR ANY CONTENT (OR PRODUCT) POSTED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SERVICES, EVEN IF ADVISED OF THEIR POSSIBILITY.

  8. RETURN OF UNUSED ARTICLES

    Besides the right of withdrawal, the company dirtlej GmbH independently offers a 30-day return from delivery of the articles. This return only exists for unused articles. As far as the customer did a "test of qualities and functions" of the articles according to 7 of the terms and conditions (warranty), this does not count as use. This right of return is only granted if the goods are complete, unused and in their original packaging.

  9. LIABILITY LIMITATIONS

    1. The company dirtlej GmbH is liable for damages – regardless of legal basis – only in cases of wilful misconduct or gross negligence.

    2. In cases of ordinary negligence, liability is limited to:

      1. Injury to life, body, or health

      2. Breach of essential contractual obligations (those that enable proper execution of the contract and on which the customer may rely). In such cases, liability is limited to foreseeable, typical damages. In this case, our warranty is limited to the replacement of the predictable, typically occurring damage.

    3. The liability limitations that result from the first points do not count if the company dirtlej GmbH fraudulently concealed a defect or took on a warranty for the quality of the articles. Same counts for your requirements according to the law on product liability.

  10. SUMMATION AND RIGHT OF RETENTION

    1. Customers may only offset claims that have been legally established or acknowledged by dirtlej GmbH.

    2. A right of retention only can be exercised by the customer if his counterclaim is part of the same contractual relationship.

  11. DATA PRIVACY

    Thank you for visiting our web page and the interest in our products. Your data will be handled confidentially and according to the EU privacy regulations, as well as according to this privacy regulation. The usage of our web page is generally possible without the collection of personal data or information. In case of a collection of personal data (e.g. Name, Address and E-Mail) it will always be voluntary and will only be used for processing orders. These data will not be shared with any third party.   12. FINAL CLAUSE

    1. If individual terms of these terms and conditions are or will be invalid, the validity of the rest of the terms and conditions remain unaffected. The invalid provision shall be replaced by the relevant statutory rule. This also applies for the filling of possible gaps in these terms and conditions.

    2. All contracts with the company dirtlej GmbH are subject to the law of the Federal Republic of Germany, excluding conflicting law and all international and supranational legal systems, in particular the United Nations Convention on Contracts for the International Sale of Goods.

    3. The contract is closed in German language. Even if these terms and conditions are available in other languages, notably in English, the German version is binding. The terms and conditions and the wording of the contract will not separately be saved by the company dirtlej GmbH.
